Port winch & sprayhood problem

The intent was never to drag the factory to court(what a task!) but to claim refund for the non-working sprayhood from the dealer. If the dealer is able to figure out a way to make it work(ability to turn the handle 360) then Im ok. If not then I can claim refund acc to norwegian law(consumer rights) without having to spend money on it, at worst case a small fee but it would normally not end up in court of law for stuff like this.

I would not advice anybody to go to court with a winch handle issue. However, we have a consumer's rights law in Sweden too and I think it should be cherished.

I agree with Ed. Save your money - don't waste it with a futile legal challenge. The sprayhood is indeed an accessory. In fact it's a real pain in the ass to fly the spinaker with the sprayhood up as well. Why didn't Hanse think of that too?
 
I rarely use my long winch handles prefering the better speed of an 8 inch handle and the more than adequate power it provides. I woould get the dealer to provide one and you will no doubt be pleased with its better feel.

Oddmund, I just thought of another way to express this. If you convert your local currency to "winch handles" - you will be paying the lawyer 2 to 3 winch handles per hour!!

Although my title is "Lawyer" when people ask me what I do I tell them that I'm a "professional problem solver."  It seems to me that this problem cries out for that type of solution.  A problem solver... not a lawyer.  Here's a problem that has effected numerous Hanse owners.  Some simply live with it  and either use a shorter winch handle or don't rotate the handle a full 360 degrees.  Others complain to each other (and occassionally to the dealer or Hanse) and get no where.  A smaller group take action.  Some get satisfaction.  Most not. Why?  Because we don't have a system in place for dealing with problems that effect all boats of a specific model (as oppossed to a problem that's unique to a specific boat).
Consider the formation of a hanse Owners Association.  All hanse owners could join for a nominal fee (to cover expenses) and the HOA could work on resolvingthese problems at one of three levels: the dealer, the distributer, or the factory.  As an owner's association (assuming we could attract many owners to join) it would have significantly more clout (power) than any one of us.
What do you think of this idea?

Just red your comments of an assosiations of Hanse owners. This is simply not possible. Have you ever seen the consumer laws in France, Italy, Spain or Norway? They are completly differnt from the US. It will take a lot of lawyers to run this assosiation, and who will it benefit? Lawyers as usual.

Sorry to disapoint you. Johan, I have no troubble with my boat that the dealer have refused to fix. Iahd a little troubble with my Simrad or, rather Jefa, steering machine, got a new one after they tested it. Conserning the port winch, I am very satisfyed with a short winchandel, deliverd with the boat.

You don't disappoint me. I am happy for you. I would love to have been in that situation myself.

The question is what you'd suggest people to do when they find themselves in a situation whereby they don't get issues fixed?

I have hired a lawyer myself and I would have loved to be part of a group of people that would fight to get what they've paid for. I have felt very lonely at times.

I don't have a sprayhood so I don't have the winch problem.

Here is the way I solved the problem. When the sprayhood was mounted it was placed on the inner side of the rail and then the handle could not turn round: 

After mounting it on the top the problem was solved:

It was just to mount the new plates and bend the bars a little bit. The bars were not shortened.
